Terms and Conditions for Hirers

Please read these Terms and Conditions carefully and all other relevant information before booking. Any booking made through us will be subject to these Terms and Conditions.

In these Terms and Conditions ‘you’ and ‘your’, Hirer’ and ‘Visitor’ means all persons named on the booking form (including anyone who is added or substituted at a later date).

‘We’, ‘us’ and ‘our’ means The Owner of the Holiday Cottage at Bwthyn Gwyrdd at Pant y Ffynnon, Cwmpengraig, Landysul, Carmarthenshire SA44 5XS.

Booking and Payment Terms
The total price for your booking and the dates booked will be set out in your confirmation e-mail or letter.
The total holiday price will be payable at the time of booking.

Right to Refuse/Alter
We have the right at our discretion to refuse any booking.
We have the right to cancel or alter arrangements before or during the holiday period provided that such cancellation or alteration is necessary:
a.due to circumstances beyond our reasonable control; or
b.to perform or complete essential remedial or refurbishment works.
If a booking is altered or cancelled by us, we will take reasonable steps to offer a suitable alternative booking. If we are not able to offer such an alternative or the hirer does not accept the alternative offered, we will return to the hirer the relevant proportion of the holiday price paid by the hirer to us.

Cancellation
If a visitor wishes to cancel a booking they must give notice in writing as soon as possible. Cancellation takes effect on the day we receive your written notification. The closer your cancellation is to your holiday start date, the less likely we are to recover the holiday costs by re-selling your Accommodation.
Our cancellation charges therefore increase as the departure date approaches.

Hirer
All bookings are made subject to availability and only becomes firm when full payment is accepted by us.
The person booking must be at least 21 years of age and have the requisite legal capability and authority to enter into a contract at the time of booking.
By making a booking the Party Leader confirms that they have authority to book on behalf of the party and that all other party members agree that the booking is subject to these Terms and Conditions.
Bookings cannot be accepted from parties of young people less than 21 years of age.

Your obligations
You agree to the following:
a) To pay before departure for any breakages, losses or damage caused by you to the property or its facilities.
b) To take all reasonable and proper care of the property and leave it in a clean and tidy condition at the end of your holiday. You will be responsible for any additional cleaning costs.
c) To inform us of any problems with the facilities or services as soon as they become apparent.
d) To permit us reasonable access to the property to carry out urgent maintenance.
e) Not to sublet or share the property except with the persons included at the booking or subsequently included by agreement. The maximum number of persons allowed at the property is clearly stated and must not be exceeded. The Owner reserves the right to terminate hire without notice and without refund where this condition is breached.
f) Not to do or omit to do something which may be or become a nuisance to neighbouring holiday accommodation or properties.

Pets
Where pets are allowed at the property the charge will be specified on the booking confirmation and you agree to the following:
a) Pets must not, at any time, be left alone at or in the property.
b) Only the number and type of pets agreed to on the booking confirmation will be allowed.
c) Pets must not under any circumstances be allowed on any soft furnishings or beds.
d) Pets must have their own beds or equivalent to protect floor coverings at all times.
e) Pets must not cause any annoyance in anyway to occupants of adjoining properties or the general public.
f) You must never allow pets to defecate in areas where children may play. Failure to clean up after pets will be heavily surcharged.

VAT
There is no extra charge for VAT on the rental price. Where it is payable on the rental price this is included in the quoted weekly rent.

Caring for your safety and comfort
We make every reasonable effort to indicate possible safety hazards in the property description and upon arrival. It is however your responsibility (particularly parents and anyone with physical restrictions) to inspect the property and grounds immediately upon arrival and note any possible hazards.

You must upon arrival check the layout of the property so that you have a planned route to exit the property as easily as possible in the event of an emergency.

Most properties are located in the countryside which can hold its own hazards such as barbed wire in fencing, hidden water springs or wells and animals in fields.

Arrival and Departure Times
The Hirer and his or her party must arrive after the arrival time (3:00pm on the first day of the holiday period) and depart before the departure time (10:00am on the last day of the holiday period).
Any stay that extends over this period will be subject to a charge being made for additional days.
The Visitor will be issued with a set of keys to the Accommodation on the first day of the holiday period and the Visitor must return them on the last day of the holiday period or the date of departure, if earlier. Failure to do so will incur the cost of a replacement set.

Right to Evict
We may terminate the Agreement on notice, and in such case the Visitor and his or her party must leave the Accommodation if:
a.this is deemed necessary by the us where there is a serious breach by the Visitor of the Agreement or the Visitor’s or his or her party’s behaviour endangers the safety of other Visitors or members of staff; or
b.any complaints are made of anti-social, unacceptable behaviour or unreasonable breakages or damage occurs or smoking restrictions are not observed.

Complaints
As most properties are in the countryside please note that regular country smells and noises will not be classed as cause for complaint.

If you do have cause for complaint remedial action should be taken as soon as possible.

As soon as a problem arises it is essential that you contact us. Discussion with us whilst you are at the property should enable the problems to be resolved straight away.

Any formal complaint in writing must to be sent to us within 7 days of the end of your rental period.

Water Supply
We cannot accept responsibility for a shortage of water at the Accommodation where this is as a result of a drought, an act or omission of the relevant water services company or for any other reason outside of the our reasonable control.

Weather
If the Accommodation becomes inaccessible due to bad weather we will take reasonable steps to inform the Visitor. We cannot be held responsible for weather related conditions that affect public roads.

Liability and Loss of Visitor Property
Lost property will normally be disposed of if it is not collected within 6 months from the end of the property hire.
We will not be liable for any loss of property or any other loss or damage caused at the property.
